These Terms & Conditions apply to the Everything is Political website, mobile applications, membership platform, events, publications, and related services operated by Everything Is Political Inc. (“Everything is Political,” “we,” “our,” or “us”).

By accessing or using our services, you agree to these Terms.

Use of the Service

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our services for personal, community, educational, or internal business purposes, subject to these Terms.

You may not copy, modify, reverse engineer, disrupt, interfere with, or misuse the services, except where permitted by law.

Memberships, Payments, and Events

Prices, benefits, billing terms, renewal terms, and cancellation options will be provided at the time of purchase. Payments are processed by third-party payment providers. We do not store complete payment card information on our systems.

Unless otherwise stated, payments are non-refundable except where required by law or expressly provided in the applicable offer, event, or purchase terms.

Intellectual Property

Everything is Political owns or licenses all rights in the services, including text, design, code, graphics, logos, trademarks, branding, software, and other materials, except for content submitted by users or third parties.

You may not use our name, logo, trademarks, branding, or proprietary materials without our prior written permission.

User Content

If you submit, post, upload, or share content through the services, you retain ownership of your content.

By submitting content, you grant Everything is Political a non-exclusive, worldwide, royalty-free license to use, reproduce, display, distribute, publish, and adapt that content as necessary to operate, promote, and improve the services.

You represent that you own or have the necessary rights to submit your content and that your content does not violate the rights of others or applicable law.

Community Standards and Acceptable Use

You agree not to post, upload, transmit, or otherwise use the services to share content that:

• Violates applicable law
• Infringes intellectual property rights
• Is defamatory, harassing, threatening, or abusive
• Incites violence or illegal activity
• Contains malware, spam, phishing, or deceptive material
• Violates another person’s privacy or personal data rights
• Impersonates another person or misrepresents your identity
• Interferes with the security or operation of the services

Moderation

We may review, remove, restrict, or disable access to content that violates these Terms, applicable law, or our community standards.

We may suspend or terminate accounts that repeatedly or seriously violate these Terms.

Copyright Policy

Everything is Political respects the intellectual property rights of others and expects users to do the same.

Everything is Political has designated a copyright agent with the United States Copyright Office in accordance with the Digital Millennium Copyright Act. If you believe content available through the services infringes your copyright, you may submit a notice to copyright@everythingispolitical.com containing:

• A description of the copyrighted work claimed to be infringed
• The location of the allegedly infringing material
• Your contact information
• A statement that you have a good-faith belief that the use is not authorized
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

Upon receipt of a valid notice, we may remove or disable access to the material while we investigate the claim.

Everything is Political may decline to remove content where a claim appears facially deficient, abusive, fraudulent, or otherwise inconsistent with applicable copyright law.

If you believe content was removed in error, including because you own the rights or believe the use constitutes fair use or other lawful use, you may submit a counter-notification.

We reserve the right to suspend or terminate accounts that repeatedly infringe intellectual property rights.

Third-Party Services and Links

Our services may contain links to third-party websites, platforms, tools, payment processors, event services, or other providers. We are not responsible for third-party services, content, policies, or practices.

Privacy

Our collection and use of personal information is governed by our Privacy Policy.

Service Changes

We may update, modify, suspend, or discontinue parts of the services at any time. We may also change features, pricing, or availability, with notice where required by law.

Availability

We aim to keep the services available and functioning, but we do not guarantee uninterrupted access. The services may be unavailable due to maintenance, updates, outages, internet issues, third-party failures, or events beyond our control.

The services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Content published through the services may include opinion, commentary, journalism, cultural analysis, third-party information, and user-generated content. We do not guarantee that all content will be complete, accurate, current, or suitable for your particular purpose.

Limitation of Liability

To the fullest extent permitted by law, Everything is Political will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, data loss, business interruption, or loss of goodwill.

To the fullest extent permitted by law, our total liability for any claim will not exceed the amount you paid to Everything is Political in the 12 months before the claim, or the minimum amount required by applicable law, whichever is greater.

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, intentional misconduct, or personal injury caused by negligence where applicable law prohibits limitation.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Everything is Political, its affiliates, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses arising from your breach of these Terms, misuse of the services, or content you submit.

Termination

We may suspend or terminate your access if you materially breach these Terms, violate applicable law, infringe rights, harm other users, or misuse the services.

Where reasonable and legally appropriate, we may provide notice and an opportunity to cure. We may act immediately where necessary to protect users, the public, the services, or Everything is Political.

Governing Law

These Terms are governed by the laws of the State of New York, without regard to conflict of law rules, except where mandatory consumer protection laws provide otherwise.

Any dispute arising from these Terms or the services will be brought in courts with proper jurisdiction, subject to any rights you may have under mandatory applicable law.

Digital Services Act

Where the European Union Digital Services Act applies, users and authorities may contact us at join@everythingispolitical.com regarding notices, content moderation, or service-related concerns.

We will review notices of allegedly illegal content and moderation appeals in a timely and reasonable manner, consistent with applicable law.

Severability

If any part of these Terms is found invalid or unenforceable, that part will be modified to the minimum extent necessary, and the rest of the Terms will remain in effect.

Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented for specific services, constitute the entire agreement between you and Everything is Political regarding your use of the services.

Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated effective date. Continued use of the services after changes take effect means you accept the updated Terms.
